Is a JCT Contract Safe

Is a JCT contract safe? In short, yes. They are utilised by the vast majority of contractors simply because they are easy to use and recognised by all relevant parties.

The most important consideration for a JCT contract is how appropriate it is for the project at hand. There are many JCT contracts tailored to different types of project and it is crucial that the right one is selected for the works. There are many guides on the JCT website as to the most applicable contract for the project.

Benefits of a JCT Contract

One of the key benefits of using a JCT contract is the fact that it has been written by an independent lawyer and is therefore constructed for the benefit of the project rather than the contractor for client.

There are very few amendable terms within a JCT contract. If the right contract has been selected the terms that apply will be relevant and in favour of a successful project. If you still have any concerns about how the contract is managed and overseen you can hire a contract administrator to administer the contract.

Is There a Risk?

There is a risk that the contractor has created a duplicate JCT contract and simply amended certain terms to suit their policies in an attempt to conceal their preferences. If you have any concerns about this at all you can discuss the contracts legitimacy with JCT or a contract administrator.
